“Comet Properties Accuses Odai Ntow Family Of Unlawful Boundary Expansion In Defiance Of 1904 Supreme Court Judgment”

The management of Comet Properties Limited, a prominent real estate development company, has accused the elders of the Nii Odai Ntow Family from Ashongman and Kwabenya in the Greater Accra Region of unlawfully extending their land boundaries, in violation of a 1904 Supreme Court judgment in the case of Bosompim v. Martei.

Comet Properties, the legal owners and developers of over 1,000 acres of land known as Comet Estates-Brekuso, has raised concerns following a public notice published in the Daily Graphic on Monday, June 24, 2024. The notice, issued by the Nii Odai Ntow Family, prompted a strong response from Comet Properties.

In a rejoinder signed by the Managing Director of Comet Properties Limited, Mr. Kwasi Peprah, and copied to this news outlet, the company vehemently disputed the claims made by the Odai Ntow Family in their public notice.

According to the rejoinder, the Odai Ntow Family’s land, totaling 12,690 acres, was clearly defined in the 1904 Supreme Court judgment in Bosompim & Ors v. Martei & Ors under Suit No. SCT2/37. Additionally, a Statutory Declaration dated 1975 and registered as No. 2551/1977 confirmed the family’s ownership of this land.

However, Comet Properties asserted that the Odai Ntow Family’s land does not extend to the 400 acres of land belonging to the Aduana Abrade family of Asabi Brekuso. To support this claim, the company attached a composite plan showing the boundaries between the Aduana Abrade family of Asabi Brekuso and the Odai Ntow family of Ashongman and Kwabenya.

“We state unequivocally that the Odai Ntow family’s land of 12,690 acres does not extend to the 400 acres of the Aduana Abrade family of Asabi Brekuso,” the rejoinder declared.

REJOINDER- TO PUBLIC NOTICE

NOTICE OF ISSUANCE OF LAND TITLE CERTIFICATE NUMBER GA 76143 TO THE ODAI NTOW FAMILY OF TESHIE, ACCRA BY THE LAND TITLE REGISTRY OF THE LANDS COMMISSION IN CONFIRMATION OF THE FAMILY’S OWNERSHIP AND TITLE TO AN AREA OF LAND MEASURING 786.65 ACRES REPRESENT IN A PORTION OF ITS KWABENYA LANDS

The Comet Properties Ltd, legal owners and developers of large tracts of land covering over 1,000 acres and known as Comet Estates – Brekuso, attention has been drawn to a public notice in the Daily Graphic dated Monday, 24th day of June, 2024 .

We respond to the said public notice and state that the ODAI NTOW FAMILY at Ashongman and Kwabenya has 12,690 acres of land as adjudged in the Supreme Court judgement of [Bosompim & Ors vrs Martei & Ors] with Suit No. SCT2/37 and also by virtue of the Statutory Declaration dated 1975 and registered as No. 2551/1977, the Odai Ntow family vested unto themselves all the lands covering 12,690 acres.

We further state that the Comet properties Ltd and its grantors, Aduana Abrade family of Asabi Brekuso in the Eastern region of Ghana affirms the Judgements of:-Judgement of the Chief Justice, Sir W. Branford Griffiths dated the 28th day of April, 1904 in Civil Suit No. SCT/2/4/37 and titled:

All in favour of the Odai Ntow family to the extent that they affirm the ALLODIAL INTEREST of the Odai Ntow family land as 12,690 acres and limits its boundaries to cover 12,690 acres.

We as Comet Properties Ltd state that we have acquired over 1200 acres of land at Brekuso in the Eastern region of Ghana since 2002 from various families in Brekuso and have developed same into a private city known as Comet Estates in the Akwapim South Municipal Assembly.

We state that our grantors, Aduana Abrade family of Asabi – Brekuso land covering 407acres shares a common boundaries with the Odai Ntow family land of 12,690 acres.

The land is vested in the Aduana Abrade family of Asabi Brekuso by virtue of a Statutory Declaration registered No. RE/749/2002 and same hold the land unto themselves as ALLODIAL OWNERS by act of settlement from time immemorial without let or hindrance or anybody laying adverse claim to the land.

We have been in possession and occupation of the land for over 20 years and has never had any litigation with the Odai Ntow family or its grantees and any judgement obtained against us or grantors to warrant a procurement of a Land Title Certificate No. GA 76143 covering 786.5 acres which includes the 407 acres of Aduana Abrade family of Asabi Brekuso lands.

It is bogus and fraudulent to use Judgements which have nothing to do with our interest in the land sharing boundaries with you to extend and trespass onto them.

The Land Title Certificate No. GA 76143 was obtained by Fraud and hence void and of no effect.

The Ngleshie Addy V family of Ga Gbese in 1995 fraudulently procured a Land Title Certificate with No. GA 6187 covering 785 acres of which 407 acres situates within the Aduana Abrade family of Asabi Brekuso whilst the rest falls and affects the Odai Ntow family land covering 12,690 acres.

We further state that the said Ngleshie Addy V family to find ways to continue to hold unto the lands fraudulently vested in itself instituted actions against the two land owning families being Aduana Abrade family and Comet Properties Ltd and in another action against Odai Ntow family;-

In 2015 the Odai Ntow family obtained judgement against the Ngleshie Addy V family in a suit culminating to the cancellation of the Land Title Certificate No. GA. 6189 covering 784.6 acres which covers 320 acres of Odai Ntow family land within the 12,690 acres adjudged as owners under the judgement of [Bosompim vrs Martei] (1904) and the 407 acres of land belonging to the Aduana Abrade family of Asabi Brekuso and alienated to the Comet Properties Ltd since 2002 with duly registered leases for 99yrs subject to terms and conditions.

The Management wish to assure our distinguished clients and grantees that as a responsible grantor their investments in the lands herein in issue are safe with us.

The Odai Ntow family cannot fraudulently and by their criminal conduct extend the boundaries of their land unto its neighbours adjoining land sharing common boundaries with them and thereby obtain a fraudulent Land Title Certificate with No. 76143, to cover and alienate Comet Properties lands.

The laws will not allow this criminal conduct of the Odai Ntow family land to have their way and run away like the case of Numo Nmaishie family of Teshie who falsified documents to convert 25 acres of land into 72,000 acres of land and it took 40 years for the Supreme Court of Ghana to set it aside on the ground of fraud.

We have continually defended the interest of Comet Properties Ltd and its grantees in the lands acquired at Comet Estates including the case with Suit No. H1/81/2017 entitled:

We conclude by stating without any equivocation that the Odai Ntow family land of 12,690 acres does not extend to the 400 acres of the Aduana Abrade family of Asabi Brekuso land and we accordingly attach a composite plan to show the limit of the Aduana Abrade family of Asabi Brekuso and Odai Ntow family of Ashongman and Kwabenya forthwith.

BY THIS NOTICE, NOTICE IS HEREBY SERVED THAT NO CUSTOMER OR GRANTEE OF COMET PROPERTIES LTD SHOULD CONTACT ANY PERSON ACTING FOR OR ON BEHALF OF THE ODAI NTOW FAMILY FOR ANY REGULARIZATION OF INTEREST AS THEIR TITLE IS FRAUDULENT AND DOES NOT EXTEND TO OUR LANDS.
